Terms of Service
1. Who we are
ondara.shop is run by José Pedro Silva, a sole trader (trabalhador independente) registered in Portugal, NIF 262355442, Rua Joaquim Lagoa, n.º 51, 6.º Esq. Frente, 4445-482 Ermesinde, Portugal ("ONDARA", "we", "us"). Email: zyva3d@gmail.com.
2. These terms
These terms apply to every order placed on ondara.shop. Please read them before ordering. They don't affect your legal rights as a consumer.
3. Our pieces
Our pieces are 3D printed to order. Fine layer lines and small differences in shade and finish between pieces, and between the piece and its photos, are part of the process. We describe each piece as accurately as we can.
4. Prices and payment
- Prices are in euros and include VAT where applicable. Delivery costs are shown separately at checkout.
- Payment is taken through Shopify's secure checkout. We never see or store your card details.
- If a price is clearly wrong because of an error, we'll contact you before shipping and you may cancel.
5. Your order
Your order is accepted when we send you the order confirmation email. If we can't fulfil an order, we'll tell you and refund you in full.
6. Delivery
Delivery is described in our Shipping policy. Risk in the piece passes to you when it's delivered to you.
7. Cancelling and returns
You can cancel within 14 days of delivery, as set out in our Returns policy.
8. Guarantee
All pieces have the legal guarantee of conformity of 3 years from delivery under Portuguese law (Decreto-Lei n.º 84/2021). If a piece is faulty, contact us and we'll repair, replace or refund it as the law provides.
9. Our liability
Our pieces are decorative. They are not toys and are not intended for food, heat, or outdoor use unless the product page says otherwise. We are not liable for losses caused by using a piece in a way it isn't intended for. Nothing in these terms limits liability that can't be limited by law.
10. Intellectual property
The designs, photographs and text on this site belong to ONDARA and may not be copied or reproduced without our permission.
11. Complaints and disputes
- Please contact us first at zyva3d@gmail.com; we'll do our best to help.
- You can also file a complaint in the Livro de Reclamações Eletrónico: https://www.livroreclamacoes.pt
- For disputes, you may go to an alternative dispute resolution entity: CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (https://www.cniacc.pt), or the consumer arbitration centre nearest you.
12. Law
These terms are governed by Portuguese law. If you live elsewhere in the EU, you keep the protection of your own country's consumer law.
